PURPOSE
- To ensure the health, safety, and the welfare of the people living and working in [NAME OF TOWN / CITY].
- To minimize conflicts between neighboring activities and uses.
- To allow greater flexibility of uses that supports the needs of the [TOWN / CITY].
APPLICABILITY
- All activities and uses associated with buildings and lots.
GENERAL
- Uses for districts, special districts, and building groups are permitted according to this Article.
- Uses in the tables are:
- Permitted, indicated by a green box labeled “Permitted”
- Permitted by special permit, indicated by a yellow box labeled “Special Permit”
- Permitted residential companion use, indicated by a blue box labeled “Residential Companion”
- Permitted in building group, indicated by a brown box labeled “Building Group”
- Permitted residential companion use and/or permitted in building group, indicated by their corresponding color coded boxes and labels above.
- Permitted use and/or permitted residential companion use, indicated by their corresponding color coded boxes and labels above.
- Uses that are not permitted are indicated by a red box labeled “Not Permitted”
- Lots, buildings, and units may contain more than one use, so long as each use is permitted.
- Residential companion uses may only occur in any of the following cases:
- When permitted uses are operated by either an owner or a renter of a dwelling unit, within the walls of their own unit.
- When permitted uses are operated by the owner of a property who occupies a dwelling unit on the same lot. Uses may be operated by the owner within the primary building, accessory building, or elsewhere on the property.
- When permitted uses are operated by someone who does not live on the lot but where the property owner occupies a dwelling unit within the primary building on the same lot.
- Uses are defined within this Article.
- Additional standards may be required for uses as indicated within this Article and must be met in order for a use to be permitted and/or to continue.
UNLISTED USES
- The [PERMITTING AUTHORITY] must classify uses on the basis of the use category.
- If a use is not listed but is similar in nature and impact to a use that is listed, the [PERMITTING AUTHORITY] must issue a written interpretation indicating which use category will be used.
NONCONFORMING USES
- Routine repair and maintenance of nonconforming uses is permitted.
- A nonconforming use may be expanded in square footage within a permitted building.
- When a nonconforming use has been changed, in whole or part, to a conforming use, that part may not be changed back to the nonconforming use.
